Host Agreement
About this agreement
This agreement is between you (the host, and the organization you list classes for) and [ENTITY], which runs Wellness Events Near Me ("we", "us"). You accept it in your dashboard before you publish a class with paid tickets. Free classes are covered by our terms and the data rules below.
What we do and what you do
- Wellness Events Near Me is a technology provider. We give you the class builder, ticketing, check-in, emails and the payment connection. We are not the organizer of your classes.
- You are the organizer and the seller. You are responsible for your classes: what you teach, safety, the venue, staff, health questions, any waiver, and what you tell buyers.
- You are the merchant of record. Paid tickets are charged on your own Stripe account, under your Stripe agreement, and paid out by Stripe to you. We never hold or pay out ticket money.
Taxes
- You are responsible for any sales, admissions or other taxes on your tickets, and for collecting, reporting and paying them.
- In Arizona this can include transaction privilege tax (TPT). Whether a class is taxed as amusement or treated as instruction depends on the class. This is not a tax determination; ask your tax advisor. [CPA] confirm.
Our fee
- Our platform fee is 2% + $0.49 per paid ticket. There is no platform fee on free events.
- The fee is taken from each paid charge on your Stripe account as an application fee. If you choose to pass it to buyers, it is included in the all-in price they see.
- You can also choose to pass card processing to buyers. The amount added for card processing is based on Stripe's standard rate for US cards. International cards, currency conversion and some card types cost more, so what you receive can be a little less than the estimate shown. [ATTORNEY] L3 confirm this wording.
Refunds and fees
Refunds and fees. Card processing fees are charged by Stripe to your Stripe account and are not returned by Stripe when a payment is refunded. You are responsible for those fees on every refund, dispute or chargeback of your tickets. If you turn on Free Cancellation, buyers' cards are held and charged 48 hours before your class, so cancellations before that point cost no fees. Payments taken inside that 48-hour window, refunds you issue after a payment is charged, disputes, and refunds for events you cancel after payment still carry the processing fee, which you pay. Our platform fee is returned only when you cancel the event.
Your refund policy and the refund floor
- Post a refund policy for each class with paid tickets. Buyers see it on the event page and at checkout before they pay.
- Answer refund requests within 5 business days.
- Give a full refund when a class is cancelled, not fully performed, or postponed and not rescheduled within 90 days, even if your own policy is stricter. See the refund policy.
- Disputes and chargebacks are handled between you, the buyer's bank and Stripe. Any dispute fee is charged by Stripe to your account.
Health, safety and insurance
- You decide who can safely take part in your class. If you use health questions, ask only what you need for safety, and read the answers before class.
- If you use a waiver, it is your waiver. Our waiver template is a starting point only; review it with your attorney.
- Do not claim that a class treats, cures or heals any condition.
- You are responsible for any insurance, licenses and permits your classes need. We recommend general liability insurance. [ATTORNEY] confirm whether to require it.
Listings and takedowns
- Listings must describe a real class you run, with accurate dates, prices, place and host name.
- No medical claims, no names or credentials you do not hold, no spam, nothing sexual or unrelated to a class.
- We screen listings and may hold, remove or take down a listing, or suspend an account, that breaks these rules. Taking down a paid class does not cancel your duty to refund its buyers.
Attendee data
- Buyers and attendees share their details with you so you can run your class. Use them only for that class: to contact attendees about it, check them in, and keep them safe.
- Do not add attendees to your own marketing list or send them promotions unless they opted in to hear from you.
- Health screening answers are sensitive. Use them only for the safety of the class they were given for. Never use them for marketing, and do not copy them out of the platform unless you need to for that class.
- Keep any attendee data you download secure. If you learn of a breach involving attendee data, tell us at support@wellnesseventsnearme.com promptly and help us respond. [ATTORNEY] set the notice deadline and the controller and processor roles.
Indemnity
- You will cover us for claims, losses and costs that come from your classes, your listings, your refunds and taxes, or your breach of this agreement. [ATTORNEY] draft the indemnity.
Changes to this agreement
- Each version of this agreement has a number. When we post a new version, you accept it in your dashboard before you can publish another class with paid tickets.
- Classes with paid tickets that are already live keep selling while you review a new version. [ATTORNEY] L3 decide whether sales should pause instead.
